Terms of Service

1. Acceptance of Terms

By accessing or using TapSavvy's services, including our website, NFC cards, QR codes, and digital business card platform (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TapSavvy provides a digital business card platform that enables users to create, manage, and share professional profiles through NFC cards, QR codes, and shareable links. Features include profile creation, contact exchange, analytics, CRM integrations, and team management.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the Service
  • One person or entity may maintain multiple profiles but only one account
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or to promote illegal activity
  • Impersonate another person or misrepresent your identity or affiliation
  • Upload malicious content, malware, or spam
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated tools to scrape, extract, or collect data from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Violate any applicable laws or regulations

5. Profile Content

You retain ownership of all content you upload to your profile. By using the Service, you grant TapSavvy a non-exclusive, worldwide license to display, distribute, and transmit your public profile content as necessary to operate the Service. You are solely responsible for the content you publish and must ensure it does not infringe on the rights of third parties.

6. NFC Cards and Physical Products

  • Physical NFC cards remain the property of the purchaser upon delivery
  • Cards are programmed to redirect to your TapSavvy profile and require an active account
  • We are not responsible for physical damage, loss, or theft of NFC cards after delivery
  • Custom card designs are subject to approval and must comply with our acceptable use policy
  • Refunds for physical products follow our refund policy

7. Billing and Subscriptions

  • Paid features require a valid payment method
  • Subscriptions renew automatically unless canceled before the end of the billing period
  • You may cancel your subscription at any time through your account settings or Stripe customer portal
  • Cancellation takes effect at the end of the current billing period
  • Refunds are handled on a case-by-case basis; contact us for refund requests
  • We reserve the right to change pricing with 30 days' notice

8. Intellectual Property

The TapSavvy name, logo, website design, and platform features are the property of TapSavvy and are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, TapSavvy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability. We are not liable for any downtime or data loss resulting from circumstances beyond our reasonable control.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your profile data will be deleted in accordance with our Privacy Policy, but NFC cards will cease to redirect to your profile.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or an in-app notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TapSavvy operates, without regard to its conflict of law provisions.
